Excerpt from; NSB Land Development Regulations Sec. 604.051 – Tree Preservation –In General-Tree Removal. It is unlawful for any person to cut down, move, remove or destroy any tree in violation of the rules of this section, this section shall apply to trees that are four inches or greater in diameter measured four feet above ground level. Trees smaller than the afore said trees (to wit: saplings) are specifically excluded and shall not be subject to the provisions of this section. If you are contemplating removing trees from your property, call New Smyrna Beach Development Services, 386-410-2850, to set up an inspection.
All “Requests for Tree Removal Approval” shall be submitted to the ACC along with a plan and permit showing generally, the location of such tree(s) in question. Any Trees removed “By Written Approval”, shall be replaced by the planting of additional trees, required by the ACC.
Finish Colors shall be applied consistently to all sides of the exteriors of buildings. Color Selections must be Harmonious with each other and with Natural Materials, and shall be “Color-Compatible” with the Natural Surroundings and Other Adjacent Property. Facia, Gutters, and Downspouts shall blend in and be directly compatible with architectural detail of the exterior walls. All Paint Schemes require ACC Approval prior to painting.
Here are a few common items that require a Building Permit; Fences, Pavers, Screen Enclosures, Re-roof, Solar panels, Pool, Shutters, Tree Removal, Driveway and Patio, Miscellaneous. Permits are required for any structural, window, and door replacement, electrical, plumbing, gas and mechanical work. Irrigation is PROHIBITED between 10 AM & 4 PM Irrigation is limited to NO more than
2 days per week on SCHEDULED days. Residential irrigation at ODD NUMBERED addresses is allowed on WEDNESDAY & SATURDAY. Residential irrigation at
EVEN NUMBERED addresses are allowed on THURSDAY & SUNDAY.
No truck (except a standard pickup truck), trailer or other commercial vehicle, and no vehicle which contains lettering or advertising thereon, OR which can be identified with a business or commercial activity, shall be parked, stored or otherwise permitted to remain on any Lot or Street Right of Way Overnight. It must be enclosed in an approved garage attached to the residence. Parking is Prohibited on Lakefronts, City Grass, (grass that is located between the Curb and Sidewalk), Vacant Lots, Emergency Trails and Association Grass. Parking Vehicles on Sidewalks is Prohibited. New Smyrna Beach Police will allow zero tolerance for the violation, and may issue tickets. Private RV or Boat: Each Homeowner is granted parking privileges for 24 consecutive hours on their Lot, (as long as it is not parked in any way on the City Sidewalks), for the purpose of cleaning and packing/unpacking for travel, prior to travel and upon return from travel.
At this time there are no restrictions on fishing in the ponds in the common areas. One cannot trespass on homeowner’s or golf course property to fish.
This applies to, but is not limited to. ALL Lawn Areas, Flower Beds, and Exterior “Hard Surface” Patio and Open Porch Areas). Does not apply to Seasonal Holiday Decorations. APPROVED LAWN AREA THINGS ARE: St. Augustine Grass, Bushes and Flowers, (See Item V-5: PLANT MATERIALS). [There is to be no “Manmade Products or Objects” in the “Front Yard”, without prior “ACC Review” and “Approval”. This includes, but is not limited to… ponds, birdbaths, rock gardens, statues, unkempt artificial flowers, gazing balls, or similar types of large accessories].
FRONT PORCHES: No “Manmade Objects”, other than things like patio furniture and potted flowers are permitted on Front Porch Floors. ALL “YARD ART/DÉCOR” REQUESTS must be submitted to the “ACC” for review and Approval.
All Fences and/or Walls, where permitted, shall be of a compatible and complimentary material and design to the adjacent building. Where a fence or wall is deemed to be unnecessary or unsightly and detracting from the Common Areas, a Landscape Screen in lieu of a Fence or Wall, shall be required. No Fence may be over six (6) feet in height and may be of picket design and shall be compatible and complimentary to the adjacent building and surroundings. No Wall may be over six (6) feet in height. All Fence and Wall types, Location, Material and Dimensions must be Approved by the ACC and have a City Permit.
At this time no signs of any character shall be placed or maintained on any Lot except a sign identifying the Owner or occupant thereof, the dimensions of which shall not exceed three (3) square feet. Real Estate signs provided that only one such sign not exceeding five and one-half (5-1/2) square feet in area may be erected for each street frontage adjoining the parcel of property offered for sale, lease, or rent. Other placement of “for rent” or “for sale” shall be as permitted by the ACC. No exterior speakers, horns, whistles or other sound devices, except security devices used exclusively to protect the security of the Lot and improvements located thereon, shall be placed or used upon any property.
